That this House recognises the urgent necessity of dealing with the small boats problem which puts at risk the lives of desperate and vulnerable people; but declines to give a Second Reading to the Illegal Migration Bill because the measures contained therein will not be effective in doing this and because the Bill fails to meet the UK’s commitment under the Refugee Convention, fails to meet the UK’s commitment under the European Convention on Human Rights, would remove the right to appeal asylum decisions, would criminalise asylum seekers for exercising their legal right to seek asylum, fails to outline the UK government’s statutory obligations on asylum, would increase delays within the Home Office and would leave many people in limbo as the backlog of asylum claims increases, would be unworkable, would cost an exorbitant amount to the taxpayer, fails to tackle smuggling gangs, does not address modern slavery concerns, fails to appoint an independent modern slavery commissioner, would leave people seeking protection at greater risk of exploitation and does nothing to address the need for faster, more efficient and humane decision-making within the Home Office.

That this House endorses the aim of saving lives and breaking the business model of people smugglers running small boat Channel crossings, as stated in paragraph 1 of the Explanatory Notes on the Illegal Migration Bill; but declines to give the Bill a Second Reading because it fails to ensure safe routes for refugees, fails to protect people, including children and victims of trafficking, from harm and exploitation by people smugglers, further expands the hostile environment for migrants which treats them as less deserving of dignity, safety and humanity and contravenes the United Kingdom’s duties under the Refugee Convention 1951 and the Protocol 1967 and other fundamental and internationally recognised human rights including the right to claim asylum, the right to family life, legal rights for detained people and the prohibition of degrading inhuman treatment.

That this House, which would support legislation to improve the effective application in the United Kingdom of laws applying to refugees, asylum-seekers and victims of modern slavery, declines to give a Second Reading to the Illegal Migration Bill because it does not contain a single measure that targets people traffickers or people smugglers, but would see people who have fled persecution such as from the Taliban and other oppressive regimes permanently excluded from refugee protection in the UK regardless of their individual circumstances and left in permanent limbo in hotels and other unsuitable asylum accommodation at huge cost to their health and to the taxpayer, would deprive victims of trafficking including sex trafficking and similar crimes of essential support under modern slavery legislation across the UK and thereby increase opportunities for organised criminals to exploit vulnerable people, would lead to mass detention, would enshrine in law arrangements that have seen hundreds of unaccompanied children go missing, would remove vital judicial safeguards and oversight, and would undermine the letter and spirit of the Refugee Convention, the European Convention on Human Rights and the European Convention on Action against Trafficking in Human Beings.

Homelessness among Ukrainian refugees in the UK

That this House calls upon His Majesty's Government to support Ukrainian refugees living in the United Kingdom; to prevent homelessness amongst this group where possible and ensure it is brief, rare and non-recurrent where it cannot be avoided; and urges His Majesty’s Government to work with partner organisations and local authorities to ensure refugees facing and experiencing homelessness are supported during their time living in the UK.

2. Bill of Rights Bill: Second Reading

This House declines to give a Second Reading to the Bill of Rights Bill, because the Bill attacks the freedoms and liberties protected by the Human Rights Act in an ideologically motivated way, is of supreme constitutional significance and will impact on the rights of individuals for many years to come but has not undergone pre-legislative scrutiny in line with the recommendations of the chairs of relevant cross-party committees, ignores the results of two consultations into the Act, vastly exceeds the manifesto commitment to update the Act, does not come with publication of relevant and robust impact assessments, ignores the fundamental principle that human rights are not earned or contingent on a person’s conduct or character but are attached to a person by virtue of their humanity, undermines migrants’ rights at a time of unprecedented international turmoil, threatens the Good Friday Agreement, risks severing the ties between domestic rights and Strasbourg jurisprudence leading to a divergence in rights protection leaving the UK out of step with other members of the Council of Europe at a time of war in Europe, fails to improve citizens’ rights to a clean, healthy and sustainable environment, to access nature and to live in a safe climate, fails to improve the rights of children, disabled people and future generations, undermines efforts to tackle violence against women and girls, and distorts and undermines this country’s democracy by increasing the power of the executive over citizens by removing and weakening rights instead of enshrining and improving them.
